The present conditions are intended for consumers who have full legal capacity. These conditions apply to all orders placed on this site. These conditions apply to all sales made from this site, to the exclusion of all other conditions, in particular those in force for in-store sales.

Article 3 : Products and services

The characteristics of the products offered for sale are presented in the various sections of our website feuillesdarbrespeintes.fr. Photographs are not contractually binding. Béatrice DE BAST (Jouty) cannot be held responsible for any errors that may appear. All texts and images presented on Béatrice’s site are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden. The price and dimensions of acrylic paintings on natural leaves always include the dimensions and price of the framed painting. Products are offered for sale while stocks last. In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability as soon as possible by e-mail or post. The headings “Artefacts”, “Leaves” and “Paintings” on our site indicate the prices in euros of the products available for sale. All prices are exclusive of VAT, in accordance with article 293 B of the French General Tax Code, and exclude any shipping costs. Shipping costs appear on the screen at the end of the customer’s selection of products. Béatrice DE BAST (Jouty) reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in force when the order is registered.

In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or taxes of state are likely to be exigible. Béatrice DE BAST (Jouty) is not responsible for these charges. They will be with your load and raise of your whole responsibility, as well in terms for declarations as for payments to the authorities and qualified organizations of your country. We advise you to check with your local authorities. All orders, whatever their origin, are payable in euros. The products remain the property of Béatrice DE BAST (Jouty) until the complete payment of the price. As soon as you take physical possession of the ordered products, the risks of loss or damage of the products are transferred to you.

Article 4 : Terms and conditions

The customer validates his/her order by clicking on the “Confirm your order” link at the bottom of the “Order summary” page, after having accepted the present terms and conditions of sale. Before this validation, the customer is systematically offered to check each of the elements of his/her order; he/she can thus correct any errors. Béatrice DE BAST (Jouty) confirms the order by e-mail; this information includes all the elements of the order and the customer’s right of withdrawal. The data recorded by the Internet site of Béatrice DE BAST (Jouty) constitute the proof of the nature, the contents and the date of the order. This one is archived by Béatrice DE BAST (Jouty) under the conditions and the legal times; the customer can reach this filing by simple request email. Béatrice DE BAST (Jouty) reserves the right not to record a payment, and not to confirm an order for some reason that it is, and more particularly in the event of problem of provisioning, or in the event of difficulty concerning the received order.

Article 5 : Online contracting

When the customer clicks on “validate my order”, a confirmation message appears. It summarizes all the products and options selected. The customer must check all the information given on the order form, and in particular all the information required for delivery (delivery address, key code, telephone numbers, etc.). If the customer does not need to modify the form, he/she must then read the present conditions. If he accepts them, he must tick the box “I have read the terms and conditions of sale and accept them unreservedly”. To finalize your order, click on “Pay my order”. After payment on our secure server (see “Payment”), an acknowledgement of receipt is displayed. It confirms that the order has been registered, and informs the customer that a confirmation e-mail will be sent as soon as possible. Article 6 : Payment

The fact of validating your order implies for you the obligation to pay the price indicated. You have several means of payment for your purchases:

Article 7 : Withdrawal right and period

In accordance with legal provisions, you may exercise your right of withdrawal within 14 days of receiving your product. You do not have to justify your decision or pay any penalty. With the exception of the cost of returning the goods, which remains at your expense, we will reimburse all sums paid within 14 days of your withdrawal. Products to be returned must be in their original condition and complete. In this case, you are liable. Any damage suffered by the product in this way may be a reason for refusing the right of withdrawal. In accordance with legal provisions, the right of withdrawal cannot be exercised for products made to order, according to the particular specifications of the consumer, or for audio, video or computer software recordings unsealed by the customer.

Article 8 : Delivery or execution

Delivery times are not guaranteed. The delivery deadline varies according to the destination address. It is normally set, for an address in metropolitan France, on receipt of payment + 15 days for the departure of the order and, for other destinations, on the day of payment + 2 months. In the event of a delay in shipment, an e-mail will be sent to inform you of any consequences on the delivery time indicated. In accordance with legal provisions, in the event of late delivery, you have the right to cancel the order under the terms and conditions defined in article L 138-2 of the French Consumer Code. In the event of confirmed non-receipt of the parcel, we will then proceed to reimburse it and the delivery costs under the conditions of article L 138-3 of the French Consumer Code. In the event of delivery by a carrier, Béatrice DE BAST (Jouty) cannot be held responsible for a delay in delivery due exclusively to the unavailability of the customer after several proposed appointments.

Article 9 : Legal guarantee

In accordance with the legal provisions in force relating to the conformity of the goods to the contract, in terms of defects, we will refund, repair or exchange any product which appears to be defective, damaged or damaged or which does not correspond to the customer’s order. We will also reimburse the full cost of return shipping upon presentation of proof.
